1. Introduction

Welcome to Sentinel SkyWorks LLC (“Sentinel SkyWorks,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, online forms, digital platforms, communications, scheduling tools, payment portals, and any related services (collectively, the “Site”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to comply with these Terms. If you do not accept these Terms, you must discontinue use of the Site immediately.

We reserve the right to update or modify these Terms at any time without notice. Continued Site use constitutes acceptance of the most current version.

2. Company Overview

Sentinel SkyWorks LLC is a Pennsylvania-based, FAA Part 107 Certified and fully insured UAS (drone) and professional imaging company providing:

  • Aerial photography & videography

  • Twilight aerial and twilight real estate photography

  • Real estate listing media and property marketing content

  • Small business photography & videography

  • 2D floor plans, 3D floor plans, and 3D video renderings

  • Aerial mapping, 3D modeling, and orthomosaic imagery

  • Construction monitoring, roof/tower/site inspections

  • Agricultural, environmental, and land documentation

  • Thermal, infrared, and multispectral imaging

  • Digital editing, sky replacements, retouching, and virtual enhancements

  • Visual content creation for commercial, agricultural, conservation, and industrial applications

All operations follow FAA Part 107 regulations and applicable state and local laws.

3. Use of the Website

By using this Site, you agree:

  • To use the Site only for lawful purposes

  • Not to interfere with the Site’s operation or attempt unauthorized access

  • Not to upload or transmit malicious code

  • Not to disrupt networks or servers connected to the Site

All content provided on the Site is for general information and marketing purposes only and does not constitute professional, engineering, surveying, or legal advice.

4. Intellectual Property Rights

4.1 Ownership of All Sentinel SkyWorks Content

All content produced, delivered, displayed, or made available by Sentinel SkyWorks LLC including but not limited to:

  • Aerial and ground photography

  • Drone video, cinematography, and thermal/IR imaging

  • Spatial maps, orthomosaic maps, georeferenced mosaics, stitched imagery

  • Topographic-style visuals, elevation models, geospatial derivatives

  • Property boundary illustrations and mapping overlays

  • 2D/3D floor plans, renderings, and virtual visualizations

  • Inspection, architectural, engineering, environmental, or industrial imaging

  • Commercial and small-business media

  • Digital downloads, documents, and all brand visuals

(collectively, “Content”)

is the exclusive property and intellectual property of Sentinel SkyWorks LLC or its licensed providers.

This ownership applies to all client types: real estate professionals, inspectors, insurers, architects, engineers, contractors, land managers, agricultural professionals, emergency services, municipalities, commercial entities, and any other individual or organization receiving or using our deliverables.

4.2 Restrictions on Use of Intellectual Property

Unless expressly permitted under your license or by written authorization, you may not:

  • Copy, reproduce, resell, or publicly distribute Content

  • Modify, crop, alter, or create derivative works without permission

  • Remove watermarks, branding, or copyright statements

  • Share Content with third parties unless they have obtained their own license

  • Claim Sentinel SkyWorks works as your own

  • Upload Content into AI training models or large datasets

  • Use Content for surveying, boundary determination, structural certification, or legal engineering conclusions

  • Use spatial or orthomosaic maps as certified geospatial data

  • Use Content in litigation without a legal-use license

Unauthorized use is a violation of intellectual property law.

4.3 License Granted Upon Final Payment

Once final payment for services has been received, Sentinel SkyWorks grants the client a full-use license to the purchased Content, subject to the following conditions:

License Characteristics:

  • Non-exclusive

  • Non-transferable

  • Fully paid, perpetual for the intended project

  • Revocable only if terms are violated

What “full-use privileges” mean for the client:

Upon final payment, the client may:

  • Use the Content freely within their business or personal operations

  • Publish Content online (websites, social media, MLS, reports, marketing campaigns)

  • Use Content in print materials, presentations, and documentation

  • Use Content for internal reports, inspections, insurance claims, evaluation, or planning

  • Display Content publicly as part of their normal marketing or operational activities

What the license does not allow even after full payment:

The following rights are not included and remain restricted:

  • Transfer or resale of Content to any other person or organization

  • Use of orthomosaic, spatial, or geospatial maps for legal surveying or certified measurements

  • Use of Content for professional engineering, architectural, or structural certification

  • Use of Content beyond the originally intended property, project, or client purpose

  • Commercial redistribution, sublicensing, or broad publication by third parties

  • AI training, dataset compilation, or machine-learning model development

Third parties (contractors, insurers, engineers, additional agents, etc.) must obtain their own licenses unless explicitly included in writing.

4.4 Special Restrictions on Spatial & Orthomosaic Maps

Spatial maps, orthomosaics, georeferenced datasets, elevation models, and topographic visuals:

  • Are for informational reference only

  • Are not surveys, legal mapping, or boundary documents

  • Cannot be used in permit applications, structural evaluations, or engineering certifications

  • Cannot determine property lines, encroachments, acreage disputes, or legal claims

  • Require attribution when used publicly

  • Require additional licensing for use in litigation, insurance disputes, or official reporting

These restrictions apply even after full payment.

4.5 Trademark & Branding Protection

All Sentinel SkyWorks logos, names, marks, taglines, icons, and brand elements are protected trademarks.

Clients may not use these marks for advertising, promotion, merchandise, websites, or business identity without written authorization.

4.6 Third-Party Licensing

Some Content includes materials licensed from external mapping, rendering, or software providers.

Use of these components is also governed by applicable third-party terms.

4.7 Reporting Unauthorized Use

Violations or suspected misuse should be reported to:

Sentinel SkyWorks retains the right to enforce all intellectual property protections.

4.8 Reservation of Rights

All rights not expressly granted in this section remain fully reserved by Sentinel SkyWorks LLC.

5. Accuracy of Service Descriptions

We strive to provide accurate service descriptions; however:

  • Services may evolve as technology advances

  • FAA regulations may restrict certain operations

  • Weather or airspace limitations may affect scheduling

  • Some services may not be available in all locations

Nothing on this Site constitutes a binding offer. All services require formal written estimates and agreements.

6. UAS Compliance and Legal Limitations

All drone operations:

  • Are conducted by FAA Part 107 Certified Remote Pilots

  • Require legal property access and client authorization

  • Must adhere to altitude, visibility, airspace, and operational restrictions

  • May be delayed or cancelled due to weather, safety, or FAA requirements

Sentinel SkyWorks does not guarantee FAA airspace approval, waivers, or on-demand authorization.

All mapping, renderings, inspections, and aerial imagery are provided for informational purposes only and do not represent legal surveys, engineering reports, or certified inspections.

7. Client Responsibilities

Clients engaging Sentinel SkyWorks are responsible for:

  • Providing accurate project details and authorized site access

  • Ensuring compliance with local ordinances and property rules

  • Verifying boundary information (if requested for mapping or overlays)

  • Securing needed permissions from landowners, tenants, or stakeholders

  • Preparing the site when relevant (e.g., interior photography, access clearance)

Failure to provide accurate information or access may result in delays, additional fees, or cancellation without refund per our Refund & Cancellation Policy.

8. Deposits, Payments & Deliverables

By booking with Sentinel SkyWorks, clients agree to the following:

  • Deposits are required to secure bookings and are strictly non-refundable

  • Additional payments follow our Refund & Cancellation Policy

  • Final deliverables (photos, videos, maps, models, plans, etc.) are released only after full payment is received

  • Digital deliverables are non-returnable and non-refundable once delivered

  • All deliverables are provided electronically through secure platforms

Use of PayPal or other payment processors is governed by their individual terms.

All payment activity on this Site is subject to the Sentinel SkyWorks Refund & Cancellation Policy, which is incorporated into these Terms by reference.

9. Third-Party Platforms & Tools

The Site may incorporate or link to:

  • PayPal

  • Scheduling software

  • Cloud storage systems

  • Mapping platforms

  • Analytics tools

  • External services

Sentinel SkyWorks is not responsible for content, privacy practices, data handling, outages, or failures of any third-party provider.

Your usage is subject to each provider’s separate Terms of Use.

10. Privacy & Data Protection

Your use of the Site is also governed by:

  • Privacy Policy

  • Legal Disclaimers

  • Refund & Cancellation Policy

These policies outline how we collect, use, store, and protect your information.

By using our Site or services, you consent to the data practices described therein.

11. Limitation of Liability

To the fullest extent permitted by law, Sentinel SkyWorks LLC, including its owners, employees, contractors, and affiliates, shall not be liable for:

  • Indirect, incidental, special, punitive, or consequential damages

  • Loss of data, revenue, opportunities, or business interruption

  • Errors, omissions, service unavailability, delays, or technical issues

  • Decisions made based on our imagery, mapping, or visual materials

  • Unauthorized third-party access to transmissions or data

Our maximum liability shall not exceed the greater of $100 or the amount paid for the specific service giving rise to the claim.

12. No Warranty

The Site is provided “as is” and “as available” without warranties of any kind, including warranties of:

  • Accuracy

  • Completeness

  • Availability

  • Fitness for a particular purpose

  • Non-infringement

Use of the Site is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Sentinel SkyWorks LLC, its owners, employees, agents, and affiliates from any claims, liabilities, losses, damages, or expenses arising from:

  • Your use of the Site

  • Your violation of these Terms

  • Your misuse of content

  • Your infringement of intellectual property or third-party rights

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of Pennsylvania state and federal courts for dispute resolution.

15. Termination of Access

We may suspend, restrict, or terminate access to the Site at any time, without notice, for violations of these Terms or for conduct deemed harmful to our company, operations, or reputation.

16. Severability

If any part of these Terms is found invalid or unenforceable, the remainder will remain in full effect.

Failure to enforce any provision shall not constitute a waiver of rights.
